General Terms and Conditions of Sale and Delivery of Narayana Verlag GmbH, Blumenplatz 2, D-79400 Kandern, Phone +49 (0) 7626 9749700, Fax +49 (0) 7626 9749709, Email info@narayana-verlag.de (hereinafter referred to as the "Seller").

1. Scope

1.1 The following terms and conditions apply to the business relationship between you (hereinafter also referred to as the "Buyer") and the Seller for orders placed via the website www.narayana-verlag.de (hereinafter the "Website").

2. Conclusion of Contract

2.1 The display of items in the online shop does not constitute a binding contract offer, but merely an invitation to the Buyer to place an order.
2.2 By clicking the "Buy" button, the Buyer submits a binding order.
2.3 After receiving the order, the Seller will send the Buyer an automatically generated confirmation of receipt. This does not yet constitute acceptance of the offer but serves only to inform that the order has been received. A contract is only concluded when the Seller declares acceptance of the contract. The Seller can accept the customer's offer within five days by:

• sending a written order confirmation or a confirmation in text form (fax or email) to the Buyer (receipt by the Buyer is decisive), or
• delivering the ordered goods (receipt by the Buyer is decisive), or
• requesting payment from the Buyer if prepayment has been selected.

If several of the aforementioned alternatives exist, the contract is concluded at the time the first of these alternatives occurs. If the Seller does not accept the Buyer's offer within the period, this shall be deemed a rejection, and the Buyer is no longer bound by their declaration of intent.

2.4 If an item ordered before the conclusion of the contract is not available because the Seller is not supplied by their supplier through no fault of their own, the Seller is entitled to withdraw. In this case, the Buyer will be informed immediately and any payments already made will be refunded.

3. Cancellation Policy for Consumers

3.1 If the customer is a consumer, the Buyer is entitled to a right of withdrawal.

3.2 Right of Withdrawal for (Physical) Goods

Right of Withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you took possession of the last goods.

You may use the attached model withdrawal form, but it is not mandatory.
Consequences of Withdrawal: We will refund all payments, including delivery costs, no later than fourteen days from receipt of the withdrawal notice. We will use the same means of payment that you used for the original transaction. Goods must be returned within fourteen days; the Buyer bears the return costs.

3.3 Right of Withdrawal for Digital Content

The right of withdrawal also exists for non-physical digital content such as eBooks or downloads. The period is fourteen days from the conclusion of the contract.

3.4 Right of Withdrawal for Services

The period is also fourteen days from the conclusion of the contract. If services begin during the withdrawal period, a reasonable amount must be paid for services already rendered.

3.5 Withdrawal Form

3.6 Exclusion of the Right of Withdrawal

• Custom-made goods
• Sealed goods for health or hygiene reasons if the seal was removed
• Goods inextricably mixed with other items
• Audio or video recordings / software in a sealed package if opened
• Newspapers, periodicals, or magazines (except subscriptions)

4. Consumer Information

Contract language: English. The contract text is not stored but can be printed immediately after ordering. After conclusion of the contract, the Buyer receives an automated email with further information.
Processing / Payment / Complaints: Information via email. Complaints can be submitted using the Seller's contact details. Statutory warranty rights apply.

5. Delivery

5.1 Shipping is carried out by a transport company selected by the Seller to the specified delivery address.
5.2 Delivery times: The periods specified on the website apply. Please notify us in case of delays.
5.3 Alcoholic beverages are only sold to Buyers aged 18 and over. Age verification required upon delivery.

6. Prices, Payment Terms, Delivery Costs, Invoices

6.1 All prices are final prices including taxes. Shipping costs are displayed on the website.
6.2 Payment options are specified on the website.
6.3 Deliveries outside the EU may incur additional costs.
6.4 For prepayment, payment is due immediately.
6.5 Information on payment service providers can be found in the Privacy Policy.
6.6-6.8 Regulations regarding retention, set-off, and electronic invoices.
6.9 Narayana Verlag fulfills take-back obligations according to the Packaging Act.

7. Warranty

Statutory provisions apply to consumers.

8. Warranty for Businesses

8.1-8.4 Supplementary regulations for entrepreneurs, including a 12-month limitation period and notification obligations for defects.

9. Liability

9.1-9.3 Seller's liability in case of intent, gross negligence, cardinal obligations, and product liability.

10. Retention of Title

10.1-10.2 The goods remain the property of the Seller until full payment. Entrepreneurs may resell the reserved goods in the normal course of business; claims are assigned to the Seller.

11. Final Provisions

11.1 Deviating GTC of the Buyer are not recognized unless agreed upon in writing.
11.2 Place of jurisdiction: Seller's registered office, unless an exclusive place of jurisdiction exists.
11.3 ODR Platform: http://ec.europa.eu/consumers/odr/. Participation in consumer dispute resolution: not willing.
