General Terms and Conditions of Sale and Delivery  

Scope:

The following General Terms and Conditions shall apply exclusively to the business relationships between Narayana Verlag and the Customer in their version applicable at the date of the order.

1. Prices:

All prices include the statutory VAT. All prices are subject to change without notice; changes and errors are reserved. Prices shall apply which are in effect on the date of the order.

2. Contract:

The contract shall come into effect when we deliver the goods in performance of the order. The declarations of intent bringing about the conclusion of the contract shall be stored by us and transferred to you upon demand by e-mail.

3. Right of withdrawal for consumers:

Right of withdrawal for physical goods

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us (Narayana Verlag GmbH, CEO: Dr. Herbert Sigwart und Dr. Katrin Sigwart, Blumenplatz 2, 79400 Kandern / Germany, Tel.: +49 (0) 7626 – 9749700, Fax: +49 (0)7626 - 974 970 9 info@narayana-verlag.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

 

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

4. Shipping Fees:

5. Forms of Payment:

The goods can be paid for by debit (only with a German bank), cash on delivery, advance payment by wire transfer or by credit card (Visa, Eurocard/Mastercard).

Payment per invoice is only possible with first orders having a value of goods up to EUR 50.00. Should nevertheless payment per invoice be desired, Narayana Verlag's agreement thereto must be obtained in advance.

6. Seminars:

Registration and Participation Fee: Registrations can be submitted by phone or in writing by e-mail, fax, webshop order or by mail. The registration is binding. Upon rescission up to 2 weeks prior to the commencement date of the seminar, a cancellation fee of EUR 25.00 shall be charged; thereafter, the registration fee can no longer be reimbursed. Confirmation of seminar participation places shall first be made after receipt of payment.

Changes and Cancellation of Events: Narayana Verlag reserves the right to cancel announced seminars due to insufficient registrations, due to temporary unavailability of the speaker or due to force majeure. The participant shall be informed hereof as quickly as possible. Fees that have already been paid shall be reimbursed in full. Further claims are precluded except in the case that the event organiser acts with wilful intent or gross negligence.

Confidentiality & Copyright: With the written confirmation of their participation, the participants agree to keep secret and confidential all patient data discussed. The speaker's documents are protected by copyright and may not be reproduced or disseminated without the consent of the author.

7. Links:

This website contains links to external websites of third parties over whose content we have no control. Therefore, we cannot accept any liability for the content of these sites. The respective provider or operator of the website is responsible for the content of the linked pages. The linked sites were examined at the time of the linking with regard to possible violations of the law. No unlawful content was evident at the time of creation of the link. A continuous monitoring of the contents of the linked sites, however, without concrete evidence of a violation of the law, is not reasonable. Should we become aware of any violations of the law, we will remove the relevant links immediately.

8. Data Protection:

All data of the customer shall be treated confidentially. The storage and processing of the data shall occur in conformity with the statutory provisions. The data shall not be transferred for use to external third parties.

9. Reservation of Title:

The goods remain our property until payment in full has been made. Should your address change in this time period, please notify us hereof immediately.

Place of performance for delivery and payment is Kandern, Germany. German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
